It could take anything from 3 weeks (if exempt) to 6 months depending on how complex your situation is e.g., listed building; conservation area; the proximity of surrounding buildings, etc. Please note that this is just an estimate and it may take longer due to the number of applications submitted at any one time; detailed architectural design work required etc.
Planning permission and building regulations approval serve different purposes. When planning permission is applied for it gives a local authority the power to control what people build, where they build it and how they go about developing their land. Planning law is primarily concerned with the use of privately-owned land – that which might potentially be built upon – whereas building regulations deal mainly with structural aspects of design.
In certain circumstances, you may not require planning permission but will still have to submit an application form for Building Regulations approval before starting work on your extension or new-build. In this case there is no fee payable as long as you meet the building regulations guidelines. If you want to make a change of use to your house, you will need to apply for planning permission.
There is no legal definition that explains the differences between these two approvals but at Mason and Marlowe we define them as below:
Building Regulations – These are required if changing, adding or removing anything within a structure which affects its “structure”, e.g., removing an internal wall; removing the roof; raising a ceiling by more than 50mm; inserting or removing load-bearing walls; change of use of a building; removing a staircase or changing the location of a door. If you are not sure if your proposed changes require Building Regulations approval, we can assess this for you and let you know whether an application is necessary or not. In most cases, it’s good to talk!
Planning Permission – This type of permission gives authority for development as detailed within planning law. It is required if the work will affect the “amenity” of the surrounding area or it exceeds certain levels of noise or disturbance at certain times. For example: imposing overlooking on neighbors; undertaking noisy works late at night; extended hours working (e.g.: change from daytime working to working between 7 am and 7 pm).
